Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) The project proponent of a registered biodiversity project may apply to the Regulator for the Regulator to issue to the project proponent a biodiversity certificate in respect of the registered biodiversity project.
(2) The application may only be made:
(a) if:
(i) a biodiversity certificate has not previously been issued in respect of the registered biodiversity project; or
(ii) a biodiversity certificate has previously been issued in respect of the registered biodiversity project and the Regulator has agreed that the application may be made; and
(b) if the conditions (if any) set out under subparagraph 45(1)(d)(i) in the methodology determination that covers the registered biodiversity project are met; and
(c) after the time worked out in accordance with provisions of that methodology determination made for the purposes of subparagraph 45(1)(d)(ii); and
(d) if the conditions (if any) set out in the rules for the purposes of this paragraph are met.
