OCCUPATIONAL HEALTH AND SAFETY (MARITIME INDUSTRY) ACT 1993 - SECT 119
Circumstances preventing compliance with Act may be defence to prosecution
It is a defence to a prosecution for refusing or failing to do
anything required by this Act or the regulations if the defendant proves that
it was not practicable to do it because of an emergency prevailing at the
relevant time.
