Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) The * approved examiner has, in the performance of his or her duties as an approved examiner, the same protection and immunity as a Justice of the High Court.
(2) A * lawyer appearing at the * examination:
(a) on behalf of the person being examined; or
(b) as or on behalf of the * responsible authority;
has the same protection and immunity as a barrister has in appearing for a party in proceedings in the High Court.
(3) Subject to this Act, the person being * examined:
(a) has the same protection; and
(b) in addition to the penalties provided by this Act, is subject to the same liabilities;
as a witness in proceedings in the High Court.
Note: In addition to the offences in this Division, there are other offences that may be relevant to examinations, such as sections 137.1 (false or misleading information) and 137.2 (false or misleading documents) of the Criminal Code .
