Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) The powers conferred on the * Official Trustee under this Part may be exercised, and the duties imposed on the Official Trustee under this Part are to be performed, in relation to property if a court orders the Official Trustee to take custody and control of the property under section 38.
(2) This property is controlled property .
(3) However, powers conferred on the * Official Trustee under Division 4 may be exercised, and the duties imposed on the Official Trustee under Division 4 are to be performed, in relation to any property that is the subject of a * restraining order, whether or not the property is * controlled property.
