Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) The Minister may, either generally or as otherwise provided by the instrument of delegation, by instrument in writing, delegate to:
(a) the person holding or performing the duties of the office of Secretary of the Department; or
(b) an SES employee, or acting SES employee, in the Department;
all or any of the Minister's powers under this Act, other than this power of delegation or a power conferred by section 17 or 18, subsection 28(3), (4) or (5) or section 38 or 47.
(2) A power so delegated, when exercised by the delegate, shall, for the purposes of this Act, be deemed to have been exercised by the Minister.
(3) A delegation under this section does not prevent the exercise of a power by the Minister.
