(1) This section applies if:
(a) the Minister is satisfied that the body appointed as the collecting society:
(i) is not functioning adequately as the collecting society; or
(ii) is not acting in accordance with its rules or in the best interests of those of its members who are resale royalty holders; or
(iii) has altered its rules so that they no longer comply with paragraphs 35(4)(b) to (d); or
(iv) has refused or failed, without reasonable excuse, to comply with section 37 or 38; or
(b) the body appointed as the collecting society requests the Minister, in writing, to revoke the appointment and the Minister is satisfied that it is in the best interests of those holding resale royalty rights to do so.
(2) The Minister may, by notice in the Gazette , revoke the appointment.
(3) The revocation takes effect on the day on which the notice is published in the Gazette or, if a later day is specified in the notice, on that later day.
