Commonwealth Consolidated Acts Commonwealth Consolidated Acts(1) This Division applies to a subpoena that is issued in a proceeding (other than an excluded family proceeding) in:
(a) a federal court; or
(b) a State or Territory court prescribed by the regulations; or
(c ) an Australian tribunal prescribed by the regulations.
(2) Regulations made for the purposes of paragraph ( 1) (c ) must not prescribe a tribunal unless the tribunal is a person or body authorised by or under a n Australian law to take evidence on oath or affirmation.
