WATER EFFICIENCY LABELLING AND STANDARDS ACT 2005 - SECT 37A

  (1)   A person contravenes this subsection if:

  (a)   the person supplies a product; and

  (b)   the product is, or purports to be, WELS - labelled; and

  (c)   the product is not a WELS product.

Strict liability offence

  (2)   A person commits an offence of strict liability if the person contravenes subsection   (1).

Penalty:   60 penalty units.

Note:   For strict liability, see section   6.1 of the Criminal Code .

Civil penalty provision

  (3)   A person is liable to a civil penalty if the person contravenes subsection   (1).

Civil penalty:   60 penalty units.
