[1] After regulation 6C

insert

6D Prescribed persons—use or disclosure of information on DNA databases

For the purposes of paragraphs 23YDAE (2) (d) and 23YO (2) (a) and (d) of the Act, a person is prescribed if:

(a)
the person is engaged or employed by a forensic laboratory that is accredited with the National Association of Testing Authorities of Australia; and

(b)
in that capacity, the person provides forensic services to law enforcement officers of the Commonwealth, a State or a Territory.

6E Corresponding laws — forensic procedures

(1)
For the purposes of the definition of corresponding law in section 23YUA of the Act, the following laws are prescribed:

(a)
the Crimes (Forensic Procedures) Act 2000 of New South Wales;

(b)
the Forensic Procedures Act 2000 of Tasmania;

(c)
the Crimes (Forensic Procedures) Act 2000 of the Australian Capital Territory.

(2)
In particular, and without limiting the generality of subregulation (1), the provisions of corresponding laws mentioned in an item in Schedule 3C are taken to substantially correspond to the provision of Part 1D of the Act mentioned in that item.
