CRIMES (OVERSEAS) (DECLARED FOREIGN COUNTRIES) AMENDMENT REGULATIONS 2004 (NO. 1) 2004 NO. 61 - SCHEDULE 1

Amendment

(regulation 3)

insert

6 Papua New Guinea

(1)
For paragraph 3C (1) (b) of the Act, Papua New Guinea is a declared foreign country for the purposes of the Act in relation to designated persons.

(2)
A person is a designated person if:

(a)
the person is deployed to Papua New Guinea as part of the package of enhanced cooperation that:

(i)
was agreed by the Government of Australia and the Government of Papua New Guinea at the 15th Australia-Papua New Guinea Ministerial Forum held on 11 December 2003; and
(ii)
is referred to in the Joint Statement published on that date; and
(b)
the person's name is notified by the Department of Foreign Affairs and Trade to the Papua New Guinea Department of Foreign Affairs and Immigration.

(3)
For subsection 3C (3) of the Act:

(a)
Papua New Guinea is to start being a declared foreign country for the purposes of the Act on the date on which this paragraph commences; and

(b)
Papua New Guinea is to cease being a declared foreign country for the purposes of the Act on 30 June 2008.
