COMMUNICATIONS, INFORMATION TECHNOLOGY AND THE ARTS LEGISLATION AMENDMENT (APPLICATION OF CRIMINAL CODE) REGULATIONS 2001 (NO. 1) 2001 NO. 337 - SCHEDULE 4
Amendment of Radiocommunications Regulations 1993
(regulation 6)
[1] Subregulations 40 (2), (3) and (4)
substitute
- (2)
- A licensee must comply with a direction under subregulation (1).
Penalty:
10
penalty units.
- (3)
- Strict liability applies to the physical element of an
offence under subregulation (2) that the direction was a direction under
subregulation (1).
- (4)
- A licensee must not engage in conduct that results in alteration to a
station or service, or to any accessory apparatus used in the operation of the
station or service, if:
- (a)
- the licensee is not acting:
- (i)
- in accordance with a direction given under subregulation (1); or
- (ii)
- with the consent in writing of an inspector; and
- (b)
- the alteration is of a kind that is likely to cause interference to
radiocommunications.
Penalty:
10 penalty units.
