1991 No. 235 CRIMES REGULATIONS (AMENDMENT) - REG 2

  2.1   Paragraph 5 (1) (d):
Omit the paragraph, substitute:

"(d) the release of a prisoner under:

        (i)    a home detention order under Part IIIa; or

        (ii)   a work release order under Part IIIB; of the Offenders
               Community Corrections Act 1963 of Western Australia.".
  2.2   Subregulation 5 (2):
Omit "elgible", substitute "eligible".
  2.3   Add at the end of the regulation:


"(3) A person convicted of a federal offence is not eligible to participate in
the pre-release permit scheme prescribed under subparagraph 5 (1) (d) (i) if
the person is subject to a recognizance release order in relation to the
offence.".
