P:\bi\06\b06-408-33\p01\b06-408-33-p01BOD.fm 11/5/06, 10:21 am Clause 1 Crimes Amendment (Murder of Police Officers) Bill 2006 The Legislature of New South Wales enacts: 1 1 Name of Act 2 This Act is the Crimes Amendment (Murder of Police Officers) 3 Act 2006. 4 2 Commencement 5 This Act commences on the date of assent. 6 3 Amendment of Crimes Act 1900 No 40 7 The Crimes Act 1900 is amended as set out in Schedule 1. 8 4 Repeal of Act 9 (1) This Act is repealed on the day following the day on which this Act 10 commences. 11 (2) The repeal of this Act does not, because of the operation of section 30 12 of the Interpretation Act 1987, affect any amendment made by this Act. 13 Page 2 P:\bi\06\b06-408-33\p01\b06-408-33-p01BOD.fm 11/5/06, 10:21 am Crimes Amendment (Murder of Police Officers) Bill 2006 Amendment Schedule 1 Schedule 1 Amendment 1 (Section 3) 2 Section 19B 3 Insert after section 19A: 4 19B Compulsory life sentences for murder of police officers 5 (1) A court is to impose a sentence of imprisonment for life on a 6 person who is convicted of murder of a police officer if the 7 murder was committed: 8 (a) while in the execution of the police officer's duty, or 9 (b) as a consequence of, or in retaliation for, actions 10 undertaken by that or any other police officer in the 11 execution of the officer's duty. 12 (2) A person sentenced to imprisonment for life under this section is 13 to serve the sentence for the term of the person's natural life. 14 (3) This section applies to a person who is convicted of murder of a 15 police officer only if the person was of or above the age of 18 16 years at the time the murder was committed. 17 (4) If this section requires a person to be sentenced to imprisonment 18 for life, nothing in section 21 (or any other provision) of the 19 Crimes (Sentencing Procedure) Act 1999 or in any other Act or 20 law authorises a court to impose a lesser or alternative sentence. 21 (5) Nothing in this section affects the prerogative of mercy. 22 Page 3 P:\bi\06\b06-408-33\p01\b06-408-33-p01SCH.fm 11/5/06, 10:21 am
