Clause 1 Crimes Legislation Amendment (Property Identification) Bill 2002 The Legislature of New South Wales enacts: 1 1 Name of Act 2 This Act is the Crimes Legislation Amendment (Property 3 Identification) Act 2002. 4 2 Commencement 5 This Act commences on a day to be appointed by proclamation. 6 3 Amendment of Acts 7 (1) The Crimes Act 1900 is amended as set out in Schedule 1. 8 (2) The Criminal Procedure Act 1986 is amended as set out in Schedule 2. 9 (3) The Pawnbrokers and Second-hand Dealers Act 1996 is amended as 10 set out in Schedule 3. 11 Page 2 Crimes Legislation Amendment (Property Identification) Bill 2002 Amendment of Crimes Act 1900 No 40 Schedule 1 Schedule 1 Amendment of Crimes Act 1900 No 40 1 (Section 3 (1)) 2 Section 194 Interpretation 3 Insert after section 194 (3): 4 (4) For the purposes of this Division, damaging property includes 5 removing, obliterating, defacing or altering the unique identifier 6 of the property. The unique identifier is any numbers, letters or 7 symbols that are marked on or attached to the property as a 8 permanent record so as to enable the property to be 9 distinguished from similar property. 10 Page 3 Crimes Legislation Amendment (Property Identification) Bill 2002 Schedule 2 Amendment of Criminal Procedure Act 1986 No 209 Schedule 2 Amendment of Criminal Procedure Act 1 1986 No 209 2 (Section 3 (2)) 3 Schedule 1 Indictable offences triable summarily 4 Insert before the heading to Table 1: 5 1A Interpretation 6 For the purposes of this Schedule, a reference to the amount of 7 damage to property in connection with a charge for an offence 8 against section 195 or 197 of the Crimes Act 1900 is a 9 reference to the total value of the property where the damage 10 consists of removing, obliterating, defacing or altering the 11 unique identifier of the property. 12 Page 4 Crimes Legislation Amendment (Property Identification) Bill 2002 Amendment of Pawnbrokers and Second-hand Dealers Act 1996 No 13 Schedule 3 Schedule 3 Amendment of Pawnbrokers and 1 Second-hand Dealers Act 1996 No 13 2 (Section 3 (3)) 3 Section 19 Duty to report suspicious goods 4 Insert at the end of section 19: 5 (2) If the licensee or employee is aware that the unique identifier 6 of the goods has been removed, obliterated, defaced or altered, 7 the licensee or employee is presumed (for the purposes of this 8 section) to suspect that the goods may have been stolen. 9 (3) In this section, unique identifier of goods means any numbers, 10 letters or symbols that are marked on or attached to the goods 11 as a permanent record so as to enable the goods to be 12 distinguished from similar goods. 13 Page 5
