CRIMINAL ASSETS RECOVERY ACT 1990 - SECT 21H
Commission must assess dispute claim
21H Commission must assess dispute claim
(1) The Commission must assess a dispute claim in accordance with this
section.
(2) The Commission must-- (a) direct that the property or, if the
interest in the property has been sold, the amount held under section 21E(2)
be returned to the claimant if the Commission reasonably believes it is more
probable than not that-- (i) the claimant has an interest in the property, and
(ii) the interest in the property is not illegally acquired property, or
(b)
otherwise--dismiss the claim.
(3) The Commission must give written notice to
the claimant of the following-- (a) the outcome of the assessment,
(b) the
reasons for the outcome,
(c) if the claim is dismissed--the way in which the
claimant may appeal the dismissal.
