CONFISCATION OF PROCEEDS OF CRIME ACT 1989 - SECT 42I
Application to confirm freezing notice
(1) An application for confirmation of the notice is to be made to the
appropriate court by an authorised officer, not later than 14 days after a
freezing notice is issued.
(2) The application is to be set down for hearing
on the first date for committal or trial proceedings for the serious offence
on which the freezing notice was based that occurs after the application is
made, or as soon as practicable after the application is made.
(3) An
applicant for confirmation of a freezing notice must give notice of the
application to the defendant, any owner of property affected by the notice and
any other person subject to the notice.
(4) A person given notice under this
section is entitled to appear and to adduce evidence at the hearing of the
application.
(5) Notice must be given in accordance with rules of court.
