Appeals against freezing notices issued by authorised justices
42K Appeals against freezing notices issued by authorised justices
(1) A defendant, an authorised officer or another person claiming an interest
in property affected by a freezing notice may, at any time before the notice
is confirmed, apply to the appropriate court to have the freezing notice set
aside or varied.
(2) An application may be heard before the day set down for
hearing the application to confirm the notice.
(3) On an application, the
appropriate court must proceed to deal with the matter under section 42L,
whether or not an application has been made under section 42I.
