CONFISCATION OF PROCEEDS OF CRIME ACT 1989 - SECT 42S
Return of property
(1) If a freezing notice ceases to be in force and the property concerned is
not subject to any other order under this Act, the person who is lawfully
entitled to it may apply to the Attorney General for the return of the
property or for payment of an amount equal to the value of the property
together with interest calculated from the date, and at the rate, prescribed
by the regulations.
(2) The Attorney General must, if satisfied that the
person is lawfully entitled to the property, return the property or pay the
amount, as the case requires, not later than 6 months after receipt of the
application.
(3) If the person who is lawfully entitled to property or to be
paid an amount under this section cannot be ascertained or an application is
not made within 6 months of the freezing notice ceasing to be in force, the
property is to be dealt with as if it had been forfeited under this Act.
