CONFISCATION OF PROCEEDS OF CRIME ACT 1989 - SECT 57
Certificate by NSW Trustee and Guardian or Commissioner of Police
57 Certificate by NSW Trustee and Guardian or Commissioner of Police
(1) If a restraining order or freezing notice is made directing the NSW
Trustee and Guardian to take control of property, a certificate under the hand
of the NSW Trustee and Guardian or an officer authorised by the Chief
Executive Officer of the NSW Trustee and Guardian and sealed with the NSW
Trustee and Guardian's seal-- (a) certifying that the restraining order or
freezing notice has been made and is in force, and
(b) stating the terms of
the restraining order or freezing notice,
shall be accepted by all courts,
officers and other persons, whether acting under any Act or not, as evidence
of the matters so certified and stated and of the NSW Trustee and Guardian's
right to act under the restraining order or freezing notice, without
production of any other proof.
(2) If a freezing notice is in force directing
the Commissioner of Police to take control of property, a certificate by the
Commissioner-- (a) certifying that the freezing notice has been made and is in
force, and
(b) stating the terms of the freezing notice,
is to be accepted by
all courts, officers and other persons, whether acting under any Act or not,
as evidence of the matters so certified and stated and of the Commissioner's
right to act under the notice, without production of any further proof.
