(1) This section applies to an offender serving an existing life sentence (as referred to in Schedule 1 to the Crimes (Sentencing Procedure) Act 1999 ) or a sentence for which a determination has been made under that Schedule.
(2) The Review Council, in exercising its functions under section 197 (2) (b) and (c), and under any other prescribed provisions of this Act or the regulations, in relation to an offender to whom this section applies--(a) must have regard to and give substantial weight to any relevant recommendations, observations and comments made by the sentencing court, and(b) must give consideration to adopting or giving effect to any such recommendations, observations and comments and to the intention of the sentencing court when making them, and(c) to the extent that it declines to adopt or give effect to any such recommendations, observations and comments, must state its reasons for doing so,and must, in particular, have regard to the need to preserve the safety of the community.
