CRIMINAL PROCEDURE ACT 1986 - SECT 42
Witnesses in mitigation
42 Witnesses in mitigation
(1) After convicting an accused person of an offence, and before passing
sentence, the court may summon witnesses and examine them on oath in respect
of any matter in mitigation of the offence.
(2) The court may do so on
application made by or on behalf of the Crown or by or on behalf of the
accused person.
