CRIMES (SENTENCING PROCEDURE) ACT 1999 - SECT 54C
Court to give reasons if non-custodial sentence imposed
(1) If the court imposes a non-custodial sentence for an offence set out in
the Table to this Division, the court must make a record of its reasons for
doing so. The court must identify in the record of its reasons each mitigating
factor that it took into account.
(2) The failure of a court to comply with
this section does not invalidate the sentence.
(3) In this section--
"non-custodial sentence" means a sentence referred to in Division 3 of Part 2
or a fine.
