New South Wales Consolidated Acts New South Wales Consolidated ActsNo civil or criminal liability is incurred by any person (including a police officer) who carries out, or helps to carry out, a forensic procedure under this Act in respect of anything properly and necessarily done or omitted to be done in good faith by the person in carrying out or helping to carry out the forensic procedure if the person believed on reasonable grounds that--
(a) informed consent had been given to the carrying out of the forensic procedure, or
(b) the carrying out of the forensic procedure without informed consent had been duly ordered by a police officer or a Magistrate or other authorised officer under this Act.
Note : This section does not provide any protection in respect of action taken maliciously or recklessly.
