CRIMINAL APPEAL RULES - REG 57
Time spent on bail or in custody not part of term
57 Time spent on bail or in custody not part of term
The time during which an appellant is at liberty on bail or detained in
custody shall not, unless the Court otherwise orders, count as part of any
term of imprisonment or penal servitude under any sentence passed upon him as
the result of the fresh trial.
