This legislation has been repealed.
The Regulation was repealed by sec 10 (2) of the Subordinate Legislation Act 1989 No 146 with effect from 1.9.2006.
His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Criminal
Assets Recovery Act 1990.
Minister for Police
The object of this Regulation is to repeal and remake, without any changes in substance, the provisions of the Drug Trafficking (Civil
Proceedings) Regulation 1995 as made under the Criminal
Assets Recovery Act 1990 (formerly known as the Drug Trafficking (Civil
Proceedings Act 1990).
In particular, this Regulation:
(a) provides for the manner in which notice of certain applications to, and orders of, the Supreme Court is to be given as required by the Act, and
(b) requires notice to be given to the Public Trustee (in addition to the New South Wales Crime Commission) of applications for orders seeking exclusion of property from forfeiture, and
(c) provides for the setting of the fees that the Public Trustee is authorised to deduct in respect of the exercise of functions in relation to property under the Act.This Regulation is made under the Criminal Assets Recovery Act 1990, including sections 19, 25, 26 and 67 (the general regulation-making power).
