AN ACT
to amend the Criminal Code
1. Short title
This Act may be cited as the Criminal Code Amendment Act 2003.
2. Commencement
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.
3. New Division
The Criminal Code is amended by inserting after Part V, Division 1 the following:
"(1) A person who manufactures, sells or offers for sale, purchases or possesses any dog or cat fur product in the Territory is guilty of an offence and is liable to imprisonment for 2 years.
"(2) Subsection (1) does not apply to the possession of a personal pet that is deceased, including a pet preserved through taxidermy.
"(3) Any dog or cat fur product manufactured, sold or offered for sale, purchased or possessed in contravention of this section is forfeit to the Territory.
"(4) It is a defence to a prosecution for an offence against this section if the defendant proves that the dog or cat fur was obtained entirely from feral animals.
"(5) In this section –
'cat fur' means the pelt or skin of any animal of the species Felis catus;
'dog fur' means the pelt or skin of any animal of the species Canis familiaris;
'dog or cat fur product' means any item of merchandise that consists, or is composed in whole or part, of any dog fur, cat fur, or both.".
