A BILL
for
AN ACT

to amend the Criminal Code

E it enacted by the Legislative Assembly of the Northern Territory of Australia, with the assent as provided by the Northern Territory (Self-Government) Act 1978 of the Commonwealth, as follows:

1. SHORT TITLE
This Act may be cited as the Criminal Code Amendment Act (No. 4) 1998.

2. COMMENCEMENT
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.

3. repeal
Section 279 of the Criminal Code is repealed.

Repeal and substitution

Section 323 of the Criminal Code is repealed and the following substituted:

"323. CHARGE OF STEALING OR RECEIVING

"Upon an indictment charging a person with —

(a) stealing any property;

(b) receiving any property knowing or believing it to have been stolen; or

the person may be found guilty of —

(d) stealing the property;

(e) receiving the property; or

(f) either stealing or receiving the property.".
