A BILL
for
AN ACT
to amend the Criminal Code
1. SHORT TITLE
This Act may be cited as the Criminal Code Amendment Act (No. 5) 1999.
2. commencement
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.
3. interpretation
Section 406 of the Criminal Code is amended by omitting from subsection (1) the definition of "sentence" and substituting the following:
"'sentence' includes —
(a) any order made by the court of trial on a finding of guilt with reference to the person found guilty or his or her property; and
(b) a determination, or a refusal to make a determination, under section 49A(2) of the Sentencing Act by the court of trial.".
