The Legislative Assembly of the Northern Territory enacts as follows:

1. Short title
This Act may be cited as the Summary Offences Amendment Act 2004.

2. Commencement
This Act comes into operation on the date fixed by the Administrator by notice in the Gazette.

3. New section 90
The Summary Offences Act is amended by inserting after section 89 the following:

"90. Obstruction etc. of emergency workers

"(1) A person must not, without reasonable excuse, obstruct or hinder an emergency worker acting in the execution of his or her duty or in the aid of the person or another person.

Penalty: If the offender is a natural person – 400 penalty units or imprisonment for 2 years.

If the offender is a body corporate – 2 000 penalty units.

"(2) In subsection (1) –

'emergency worker' means a person who works (whether paid or unpaid) for an emergency relief organisation and includes an ambulance officer and a volunteer member of the Fire and Rescue Service.".
