If:
(a) an ACC Territory intelligence operation is determined by the Board to be a special operation; or
(b) an ACC Territory investigation is determined by the Board to be a special investigation,
then, except in a proceeding instituted by the Attorney-General of the Commonwealth or of a State or Territory, any act or thing done by the ACC because of that determination must not be challenged, reviewed, quashed or called in question in any court of the Territory on the ground that the determination was not lawfully made.
