The Parliament of Queensland enacts-- 1
Part 1 Preliminary 2
Clause 1 Short title 3
This Act may be cited as the Summary Offences and Other 4
Acts Amendment Act 2006. 5
Clause 2 Commencement 6
(1) Sections 4, 5, 7, 8, 12, 13, 15 and 16 commence on a day to be 7
fixed by proclamation. 8
(2) Part 5 commences immediately after the commencement of 9
the Prostitution Amendment Act 2006, part 2. 10

This part amends the Summary Offences Act 2005. 14

`23A Seller must take prevention measures in relation to 4
spray paint 5
`(1) This section applies in relation to selling spray paint. 6
`(2) A seller who is an employer must take prevention measures in 7
relation to each employee of the seller. 8
Maximum penalty--40 penalty units. 9
`(3) The seller takes prevention measures for subsection (2) in 10
relation to an employee if the seller-- 11
(a) instructs the employee-- 12
(i) not to sell spray paint to minors in any 13
circumstances, even if the sale is for, or claimed to 14
be for, an adult; and 15
(ii) to sight acceptable evidence of age for a person 16
before selling spray paint to the person, unless 17
satisfied the person is an adult; and 18
(b) warns the employee that if the employee disregards the 19
instructions mentioned in paragraph (a) and sells spray 20
paint to minors, the employee commits an offence 21
against section 23C; and 22
(c) obtains written acknowledgment by the employee that 23
the employee received the instructions and warning 24
mentioned in paragraphs (a) and (b). 25
`(4) In this section-- 26
acceptable evidence of age see section 23B. 27
`23B Sale of spray paint to minors 28
`(1) A seller of spray paint must not sell spray paint to a minor. 29
Maximum penalty-- 30
(a) for a first offence--140 penalty units; or 31
(b) for a second offence--280 penalty units; or 32

(c) for a third or later offence--420 penalty units. 1
`(2) An employee who sells spray paint to a minor in the course of 2
the employment can not be prosecuted under this section. 3

`(3) It is a defence to a charge of an offence against subsection (1) 7
for the seller to prove-- 8
(a) that the seller, or an employee of the seller, required a 9
person to produce acceptable evidence of age; and 10
(b) the person produced acceptable evidence of age 11
showing the person was not a minor; and 12
(c) the seller or employee had no reason to believe the 13
evidence was false. 14
`(4) Also, for the purposes of the Anti-Discrimination Act 1991, 15
section 46, a seller is not to be taken to discriminate against a 16
person only because the seller refuses to sell spray paint to the 17
person because of subsection (1). 18
`(5) In this section-- 19
acceptable evidence of age, for a person, means a document 20
that-- 21
(a) is a driver licence, proof of age card or an Australian or 22
foreign passport; and 23
(b) bears a photograph of the person; and 24
(c) indicates by reference to the person's date of birth or 25
otherwise that the person has attained a particular age. 26
`23C When employee of seller liable 27
`(1) This section applies if a seller has, in relation to an employee 28
of the seller, taken the prevention measures mentioned in 29
section 23A(3). 30
`(2) The employee of the seller must not, in the course of the 31
employee's employment, sell spray paint to a minor. 32

Maximum penalty-- 1
(a) for a first offence--20 penalty units; or 2
(b) for a second or later offence--40 penalty units. 3
`(3) For deciding whether a person has committed a second or 4
later offence for subsection (2), it does not matter whether the 5
prevention measures taken in relation to the employee were 6
taken by the same or a different employer. 7
`23D Seller of spray paint must display prohibition sign 8
`(1) A seller of spray paint who is an employer must display, as 9
prescribed under a regulation, a prohibition sign at each point 10
of sale at the seller's retail outlet. 11
Maximum penalty--20 penalty units. 12
`(2) In this section-- 13
point of sale means a counter or similar fixture where spray 14
paint may be sold. 15
prohibition sign means a sign about the supply of spray paint 16
to minors complying with the requirements prescribed under a 17
regulation. 18
retail outlet means premises where spray paint is available for 19
sale to the public. 20
`23E Provision about definition of sell for ss 23A-23D 21
`(1) This section applies for the application of the definition sell in 22
the dictionary to sections 23A to 23D. 23
`(2) A seller does not keep or expose for sale or offer to sell spray 24
paint to a minor only because the seller keeps or exposes for 25
sale or offers to sell spray paint to the public generally.'. 26

`24A Unlawful SMS messages etc. 1
`(1) A person must not, in trade or commerce, provide, in 2
Queensland or elsewhere, a service of informing another 3
person of the location of a traffic enforcement site for the 4
purpose of, or that has the effect of, enabling the other person 5
to avoid, or be prepared for, a check made at the site. 6
Maximum penalty--100 penalty units. 7
`(2) For subsection (1), a person provides a service of informing 8
another person of the location of a traffic enforcement site if 9
the person makes information about the location of a traffic 10
enforcement site available to the other person by a relevant 11
message. 12
`(3) Subsection (1) does not apply to the provider of a telephone 13
service or an internet service provider only because another 14
person uses the provider's telephone or internet service to 15
inform someone else of the location of a traffic enforcement 16
site. 17
`(4) In this section-- 18
internet message means a message that may be viewed by a 19
person on a website. 20
message includes information in any form, whether or not for 21
a particular person. 22
relevant message means any of the following that informs a 23
person of the location of a traffic enforcement site-- 24
(a) an internet message; 25
(b) an SMS message; 26
(c) another type of message that may be heard, read or 27
otherwise viewed by a person using a mobile phone. 28
SMS message means a text message sent using the mobile 29
phone service known as the short messaging service. 30
traffic enforcement site means a place being used by a police 31
officer to perform random or systematic checks of compliance 32
by drivers with the Transport Operations (Road Use 33
Management) Act 1995. 34

(a) any liquid or other substance in a spray can that, if 2
applied to a surface of a thing by using a spray can, is 3
designed to colour, stain, mark or corrode the surface of 4
the thing; and 5

`43A Unlawful sale of spray paint to minors 1
`(1) This section applies if a police officer-- 2
(a) either-- 3
(i) observes a person being sold a thing the police 4
officer reasonably suspects is spray paint; or 5
(ii) reasonably suspects a person has just been sold 6
spray paint; and 7
(b) reasonably suspects the person is under 18 years. 8
`(2) A police officer may-- 9
(a) ask the person to show acceptable evidence of age of the 10
person; and 11
(b) require the person to produce the thing sold to the 12
person. 13
`(3) The police officer may seize the spray paint if-- 14
(a) the person either-- 15
(i) refuses, or is unable, to show acceptable evidence 16
of the person's age; or 17
(ii) shows acceptable evidence of age of the person 18
showing the person is under 18 years; and 19
(b) the police officer reasonably suspects the spray paint is 20
evidence of an offence against the Summary Offences 21
Act 2005, section 23B or 23C. 22
`(4) In this section-- 23
acceptable evidence of age has the meaning given under the 24
Summary Offences Act 2005, section 23B. 25
spray paint has the meaning given under the Summary 26
Offences Act 2005, schedule 2.'. 27

disposed of in a way required under the Drugs Misuse 2
Regulation 1987 is taken to have been destroyed. 3

in which the drug matter may be relevant has not been started 5
or, if started, has not been decided.'. 6
