CEO to manage ACC operations/investigations
6 CEO to manage ACC operations/investigations
(1) The CEO is to manage, coordinate and control ACC
operations/investigations.
(2) As soon as practicable after the Board
consents under section 55A (3) of the ACC Act to the ACC undertaking an
intelligence operation under section 5 (a) or conducting an investigation
under section 5 (b) , the CEO must determine, in writing, the head of the
operation or investigation.
(3) Before the CEO determines the head of the
operation or investigation, the CEO must consult the chair of the Board, and
the other members of the Board the CEO thinks appropriate, in relation to the
determination.
(4) Subject to the consultation with the examiners as is
appropriate and practicable, the CEO may make arrangements as to the examiner
who is to be able to exercise his or her powers under this Act in relation to
a special ACC operation/investigation.
