CRIMINAL CODE 1899 - SECT 101
Bribery
101 Bribery
(1) A person who— (a) asks for or receives; or
(b) offers, or agrees, to
ask for or receive;
a benefit, whether for the person or for another person,
on the understanding that the person’s election conduct will be influenced
or affected commits a misdemeanour. Penalty— Maximum penalty—1
year’s imprisonment.
(2) A person who, in order to influence or affect
the election conduct of another person (the
"affected person" ), gives a benefit to any person (whether or not the
affected person) commits a misdemeanour. Penalty— Maximum penalty—1
year’s imprisonment.
(3) In this section—
"election conduct" of a person means— (a) the person’s voting or not
voting at an election; or
(b) the way in which the person votes at an
election; or
(c) the person’s nominating as a candidate for an election; or
(d) the person’s support of, or opposition to, a candidate at an election.
"give" includes promise and offer to give.
