If—
(a) a presiding officer at an election agrees to help an elector who is blind, or otherwise unable to vote without help, by marking the elector’s ballot paper for the elector; and
(b) the presiding officer wilfully fails to mark the ballot paper—the presiding officer commits a misdemeanour.(i) in the way requested by the elector; and(ii) in the sight of anyone else lawfully present;
Penalty—Maximum penalty—3 years imprisonment.
