Conspiracy to bring false accusation
131 Conspiracy to bring false accusation
(1) Any person who conspires with another to charge any person or cause any
person to be charged with any offence, whether alleged to have been committed
in Queensland, or elsewhere, knowing that such person is innocent of the
alleged offence, or not believing the person to be guilty of the alleged
offence, is guilty of a crime.
(2) If the offence is such that a person
convicted of it is liable to be sentenced to imprisonment for life, the
offender is liable to imprisonment for life.
(3) If the offence is such that
a person convicted of it is liable to be sentenced to imprisonment, but for a
term less than life, the offender is liable to imprisonment for 14 years.
(4)
In any other case the offender is liable to imprisonment for 7 years.
(5) The
offender can not be arrested without warrant.
(6) A prosecution for an
offence defined in this section shall not be instituted without the consent of
the Attorney-General.
