Distributing information about avoiding detection
228DC Distributing information about avoiding detection
(1) A person who distributes information about how to avoid detection of, or
prosecution for, conduct that involves the commission of a
child exploitation material offence commits a crime. Penalty— Maximum
penalty— (a) if the offender uses a hidden network or an anonymising service
in committing the offence—20 years imprisonment; or
(b) otherwise—14
years imprisonment.
(2) The Penalties and Sentences Act 1992 , section 161Q
also states a circumstance of aggravation for an offence against this section.
(3) An indictment charging an offence against this section with the
circumstance of aggravation stated in the Penalties and Sentences Act 1992 ,
section 161Q may not be presented without the consent of a Crown Law Officer.
(4) In this section—
"child exploitation material offence" means an offence against section 228A ,
228B , 228C , 228D , 228DA , 228DB or this section.
