Maximum penalty for indictable offences dealt with summarily
552H Maximum penalty for indictable offences dealt with summarily
(1) A person is liable on summary conviction under section 552A , 552B or
552BA to a maximum penalty ofโ (a) if the Magistrates Court is a court
constituted by a magistrate imposing a drug and alcohol treatment order under
the Penalties and Sentences Act 1992 , part 8A โ100 penalty units or 4 years
imprisonment; or
(b) if the Magistrates Court is constituted by a magistrate
other than a magistrate mentioned in paragraph (a) โ100 penalty units or 3
years imprisonment; or
(c) if the Magistrates Court is constituted by
justices under section 552C (1) (b) โ100 penalty units or 6 months
imprisonment.
(2) However, in no case may the person be punished more than if
the offence had been dealt with on indictment.
