Right of appellant to be present
671D Right of appellant to be present
(1) An appellant, notwithstanding that the appellant is in custody, shall be
entitled to be present if the appellant desires it, on the hearing of the
appellant’s appeal or subsequent appeal.
(1A) However, the appellant is not
entitled to be present, without leave of the Court, for any of the
following— (a) an appeal on some ground involving a question of law alone;
(b) an application for leave to appeal or leave to make a subsequent appeal;
(c) any proceedings preliminary or incidental to an appeal or subsequent
appeal.
(2) The power of the Court to pass any sentence may be exercised
notwithstanding that the appellant is not present.
