CRIMINAL CODE 1899 - SECT 755
Existing relevant proceedings
(1) This section applies in relation to a relevant proceeding started, but not
finally decided, before the commencement.
(2) Subsection (3) applies in
relation to the relevant proceeding if, before the commencement— (a) a
request was made to the prosecution under section 590AS(3) to allow an
appropriate person to view or examine original evidence that is the body of a
deceased person; or
(b) the court hearing the proceeding made a direction
under section 590AS(4) in relation to viewing and examining original evidence
that is the body of a deceased person; or
(c) the accused person applied to
the court for a direction mentioned in paragraph (b).
(3) Section 590AS, as
in force from time to time before the commencement, continues to apply in
relation to the relevant proceeding as if the
Evidence and Other Legislation Amendment Act 2022 had not been enacted.
(4)
If subsection (3) does not apply in relation to the relevant proceeding,
section 590ASA applies in relation to the proceeding.
(5) In this section—
"appropriate person" see section 590AS(6).
"body" see the Coroners Act 2003, schedule 2.
"original evidence" see section 590AD.
"relevant proceeding" see section 590AD.
