Bribery
98C Bribery
(1) A person who— (a) asks for or receives; or
(b) offers, or agrees, to
ask for or receive;
a benefit of any kind, whether for himself or herself or
for someone else, on the understanding that the person’s election conduct
will be influenced or affected is guilty of a crime. Penalty— Maximum
penalty—7 years imprisonment.
(2) A person who, in order to influence or
affect another person’s election conduct, gives a benefit of any kind to
anyone is guilty of a crime. Penalty— Maximum penalty—7 years
imprisonment.
(3) In this section—
"election conduct" of a person means— (a) the way in which the person votes
at an election or referendum; or
(b) the person’s nominating as a candidate
for an election; or
(c) the person’s support of, or opposition to, a
candidate or a political party at an election; or
(d) the person’s approval
or disapproval of the Bill or question submitted to the electors at a
referendum.
"give" includes promise or offer to give.
