CRIMINAL PROCEEDS CONFISCATION ACT 2002 - SECT 147
Notice of application
147 Notice of application
(1) The State must give written notice of the application for the forfeiture
order to the person whose conviction is the basis for the application and
anyone else the appropriate officer making the application for the State
considers has an interest in the property to which the application relates.
(2) A person given notice under subsection (1) may appear at the hearing of
the application.
(3) Anyone else who claims an interest in the property may
also appear at the hearing of the application.
(4) The absence of a person
given notice under subsection (1) does not prevent the court from making a
forfeiture order.
