CRIMINAL PROCEEDS CONFISCATION ACT 2002 - SECT 204
How particular amounts may be treated
204 How particular amounts may be treated
(1) This section applies if, at the hearing of an application for a special
forfeiture order, evidence is given that the value of the prescribed
respondent’s property after the making of the relevant contract was more
than the value of the property before the making of the contract.
(2) The
Supreme Court must treat the difference as the value of the benefit received
by the person from the contract, other than to the extent the court is
satisfied the reason for the difference was not related to the making of the
contract.
