CRIMINAL PROCEEDS CONFISCATION ACT 2002 - SECT 272
Automatic forfeiture
272 Automatic forfeiture
(1) Property that is liable to automatic forfeiture under the old Act is taken
to be liable to automatic forfeiture under this Act and any step necessary to
be taken for enforcing the forfeiture may be taken under this Act.
(2) For
working out when property liable to automatic forfeiture under the old Act is
forfeited to the State, section 163 of this Act applies to the property as if
it had commenced on the day section 25 of the old Act first applied to the
property.
(3) However, if, before the commencement of this section, the
forfeiture period under the old Act has been extended and the extended
forfeiture period ends after the commencement of this section— (a) the
property is forfeited to the State when the forfeiture period as extended
under the old Act ends; and
(b) the person may not apply for an extension of
the forfeiture period under this Act; and
(c) the Supreme Court may not
extend the forfeiture period under this Act.
