CRIMINAL PROCEEDS CONFISCATION ACT 2002 - SECT 57
Notice of application
57 Notice of application
(1) The commission or, if the application is made for the State by a police
officer, the commissioner of the police service must give written notice of
the application to each person whose property is restrained under the
restraining order and anyone else the commission or the commissioner of the
police service considers has an interest in the restrained property.
(2) A
person given notice under subsection (1) may appear at the hearing of the
application.
(3) Anyone else who claims any of the property may also appear
at the hearing of the application.
(4) The absence of a person given notice
under subsection (1) does not prevent the court from making a forfeiture
order.
