CRIMINAL PRACTICE RULES 1999 - REG 39
Service—minors
39 Service—minors
(1) Subject to subrule (2) , a person serving a subpoena on a minor must serve
it instead on— (a) the minor’s parent or guardian; or
(b) if there is no
parent or guardian, an adult who has the care of the minor or with whom the
minor lives.
Editor’s note— A
"minor" is an individual who is under 18 years†” Acts Interpretation Act
1954 , schedule 1.
(2) A person serving a subpoena on a minor who is over
16 years may serve it on the minor only if the minor— (a) does not have a
parent or guardian; or
(b) is not apparently in the care of an adult or does
not apparently live with an adult.
