CRIMINAL PRACTICE RULES 1999 - REG 54AD
When interpreter must be provided for accused person
(1) This rule applies if the court is satisfied that an accused person in a
proceeding can not understand and speak the English language sufficiently to
enable the accused person to— (a) understand and participate in the
proceeding; or
(b) understand, and make adequate reply to, questions that may
be put to the accused person in the proceeding.
(2) The court must ensure the
accused person is provided with an interpreter.
(3) If an interpreter is
provided under subrule (2), the court is responsible for engaging and bearing
the costs of the interpreter.
