Certificate of conviction
72 Certificate of conviction
(1) This rule applies if a person (the
"requester" ) asks the proper officer of the court of trial before which a
person was convicted of an indictable offence to give to the requester a
certificate of the person’s conviction.
(2) The proper officer may give the
certificate to the requester only if— (a) the appeal period for the offence
has ended; and
(b) an appeal or subsequent appeal has not started, or a
notice of application for leave to appeal or notice of application for leave
to make a subsequent appeal has not been filed.
(3) If an appeal or
subsequent appeal has started, or a notice of application for leave to appeal
or notice of application for leave to make a subsequent appeal has been filed,
the proper officer may give the certificate to the requester only if— (a)
the final decision on the appeal, subsequent appeal or application has been
given; or
(b) the appeal, subsequent appeal or application has been
abandoned.
