112—Matters taken into account in deciding whether to make
literary proceeds orders
In determining whether to make a literary proceeds order, the court may take
into account any matter it thinks fit, and must take into account—
(a) the
nature and purpose of the product or activity from which the literary proceeds
were derived; and
(b)
whether supplying the product or carrying out the activity was in the public
interest; and
(c) the
social, cultural or educational value of the product or activity; and
(d) the
seriousness of the offence to which the product or activity relates; and
(e) how
long ago the offence was committed.
