252—Demanding or requiring benefit on basis of public office
(a)
demands or requires from another person a benefit (whether for himself or
herself or for a third person); and
(b) in
making the demand or requirement—
(i)
suggests or implies that it should be complied with
because the person holds a public office (whether or not the person in fact
holds that office); and
(ii)
knows that there is no legal entitlement to the benefit,
is guilty of an offence.
Maximum penalty: Imprisonment for 7 years.
(2)
Subsection (1) does not apply to a demand made by a public officer to a
proper authority in relation to the officer's remuneration or conditions of
appointment or employment.
