The provisions of section 78 do not extend to any person going through
the form or ceremony of marriage as mentioned in that section—
(a)
whose spouse has then been continuously absent from that person for the last
seven years and has not been known by that person to be living within that
time; or
(b)
whose marriage has been dissolved or declared void by any court of competent
jurisdiction.
